Stormwater Compliance & Sealcoating in Winston-Salem — What Property Owners Need to Know
Winston-Salem does not currently have a coal tar sealcoating ban, but the city operates one of the most actively enforced stormwater programs in North Carolina — and that matters for anyone maintaining a commercial parking lot here. Under Winston-Salem’s Stormwater Management Ordinance (Chapter 75 of the City Code), the city has authority to inspect properties for stormwater compliance, issue notices of violation, and levy civil penalties for any discharge of pollutants into the storm drain system. Each day a violation continues counts as a separate offense.
Why does this matter for sealcoating? Coal tar-based sealers contain extremely high concentrations of polycyclic aromatic hydrocarbons (PAHs) — toxic chemicals classified as probable human carcinogens by the EPA. When coal tar sealer wears down, PAH-laden dust and particles wash off the pavement surface and enter the storm drain system, flowing directly into local waterways. The Salem Creek watershed, which runs through Winston-Salem, has already been identified by the NC Division of Water Quality as biologically impaired. The city actively monitors it.
